Prosecutors are arguing that Kelly had no basis for firing what Kelly described as warning shots over men he claimed were carrying AK47’s on his ranch. The body of Gabriel Cuen-Buitimea, 48, a Mexican citizen who was deported several times in the past for illegally entering into the United States, was later discovered on Kelly’s ranch.
